How do the courts decide if a contract is legally binding?

A contract is a legally binding and enforceable agreement made between two or more parties. In cases of dispute over whether a contract, or elements of it, have been broken, it may be necessary to take the case before the courts so that a judgement can be made about whether there has been a breach.
